Zola is an admitted attorney of the High Court of South Africa. He has advised a number of corporate and public sector clients in a range of labour and employment related matters. Zola regularly appears at the CCMA, Labour Court and various bargaining councils. He has extensive experience in the Higher Education, Retail and Banking Sectors. In addition, Zola has a particular interest in sports and immigration law and has acted for a number of corporate and individual clients in this regard.


CAREER

Zola completed his LLB degree at the University of the Western Cape in 2014 where he graduated amongst the top 7 students in his class. He commenced his career in 2015 as a candidate attorney at Cliffe Dekker Hofmeyr and was later appointed as an associate in the firm’s employment law department. Zola is currently finalising his thesis and shall soon graduate with an LLM in Employment Law from the University of Cape Town.

EXPERIENCE

Zola has advised both corporate and public sector clients across a wide range of labour and employment related matters. These include matters relating to employment equity, executive terminations, high-level disciplinary issues and disputes, unfair dismissals, unfair labour practices, organisational rights, restraint of trade and industrial action disputes such as strikes and lockouts. Zola also has experience in drafting employment agreements, policies and procedures and the conducting of forensic and internal workplace investigations. He regularly conducts seminars and training on a diverse range of employment related topics. Zola has extensive experience in litigious matters and often appears at the CCMA and Bargaining Councils.

Zola has also advised clients in relation to various immigration and sports law issues. He has a keen interest and considerable knowledge in the National Soccer League in South Africa rules and regulations, as well as the procedures and processes of the NSL Dispute Resolution Chamber.

Gavin is an admitted attorney of the High Court of South Africa with 20 years of experience in practice. He commenced his articles of clerkship in 2000 at Hofmeyr Herbstein and Gihwala Inc and was later promoted to director / partner in 2006. He joined Cliffe Dekker Hofmeyr Inc. in 2008 following the merger between Hofmeyr and Cliffe Dekker. On 1 August 2019 Gavin formed Mcaciso Stansfield Inc. together with his partner Zola Mcaciso.


EDUCATION

Gavin holds the degrees BA LLB LLM after having graduated from the University of Cape Town in 1999. He also obtained a Higher Diploma in Company Law in 2009 and an advanced Certificate in Pension Law in 2013. Gavin is also FAIS (Financial Advisory and Intermediary Services Act) certified having completed his RE1, 3 & 5 examinations in 2015.

LABOUR & EMPLOYMENT

Gavin has represented and advised several private and publicly listed corporate entities and has acted across all spheres of government in South Africa viz. national, provincial and local. He specialises in executive terminations and high-level disciplinary issues involving directors, executives and other senior personnel. Gavin has extensive knowledge and experience in fraud, corruption, breaches of finding duties and white-collar crime. He regularly appears in the Labour Court, High Court, CCMA, SALGBC and private arbitration forums in labour and employment disputes. He has also appeared in the Labour Appeal Court and Constitutional Court on numerous occasions in employment related matters. Gavin also specialises in the drafting of high-level employment agreements including covenants in restraint of trade. He also specialises in public service employment disputes involving senior ranking employees and officials.

Administrative and Constitutional Law, Corporate and Forensic Investigations, Fraud and Corruption and White-Collar Crime

Gavin specialises in corporate investigations, fraud and corruption and white-collar crime in both the public and private sectors. In 2010, he was the lead forensic investigator in the SAPS Sanlam Middestad lease transaction into alleged tender fraud and corruption. Gavin has also led a number of forensic investigations for numerous corporate and public sector clients which has included testifying as an expert witness. He has extensive experience in supply chain management and procurement legislation, supply chain management processes, tender irregularities and tender fraud. He has recently appeared in the Constitutional Court involving the review of a public tender.

Gavin is an Eskom certified Occupational, Health and Safety incident investigator.

COMMERCIAL LITIGATION

Gavin has acted for a number of corporate and publicly listed clients in urgent High Court applications in respect of restraint of trade and unlawful competition interdicts, damages actions, trademarks and copyright. He has advised extensively on shareholder and director disputes including applications in terms of the Companies Act.

FINANCIAL SERVICES & PENSION LAW

Gavin has extensive experience in the Financial Advisory and Intermediary Services Act (FAIS) and has recently appeared in the Financial Services Tribunal on FAIS and Financial Sector related matters. He has also advised pension funds and trustees in relation to the Pension Funds Act in South Africa.

Heineke held senior executive management positions with several multi-national companies in the hotel & leisure industry for the past 20 years and successfully led the HR discipline across an ever-expanding portfolio of countries, businesses, owners and employees. Returning to South Africa after 10 years abroad, Heineke decided to seize the moment and joined Mcaciso Stansfield Inc. as Candidate Attorney to pursue his dream of practicing law.


CAREER

Working since 1992 in HR specialist positions across various industries, he entered the 5-star hotel industry in 1998 as HR Manager and opening team member of Sun International’s prestigious Zimbali Lodge & Golf Resort. Promoted soon thereafter to Director of HR at the world-renowned Table Bay Hotel, he was a member of the Excom team when this hotel was voted in 2002 by Conde Nast Traveler (USA) as Best Luxury Hotel in Africa & Middle East and 4th Best Hotel in the World. From 2004 to 2010, he gained valuable multi-property experience as Group Director of Human Resources for Arabella Starwood South Africa, supporting 1,500 employees and leading the HR discipline over a mixed portfolio of business units, including 2 hotels, a Wine Farm and Bavarian Brewery & Restaurant. Moving to Brussels in 2011 to join the Starwood Africa & Indian Ocean (AFIO) Office as Regional Director of HR, Heineke successfully led the HR discipline across 34 operating and 23 pre-opening hotels, supporting 12,000 employees and discharging his duties over 22 countries. In 2014 he was instrumental in moving Starwood’s AFIO Office from Brussels to Dubai in 2014. Following the acquisition of Starwood Hotels by Marriott International in 2017, Heineke was appointed as Area Director of HR for Sub-Saharan and North Africa. Based in Dubai, he led the human resources discipline over a geographical area compromising 24 countries, 45 operating Hotels, 58 pre-opening Hotels and 17,000 employees. In 2018 he successfully led the integration 30+ Starwood Hotels into Marriott’s systems & culture. Returning home to South Africa in with his family in 2020, Heineke joined Mcaciso Stansfield Inc. as Candidate Attorney to pursue his dream of practicing law.
